Eric Leon, 31, of 10356 36th St., Ozone, N.Y., was charged with carrying and brandishing a facsimile firearm, three counts risk of injury, second-degree breach of peace and first-degree threatening. Police said the weapon was a pellet gun.
The incident started when Leon was in the store with his 7-year-old stepdaughter at 9 p.m. and angrily accused another customer of standing too close to her, police said. He repeatedly told the other customer to step back, police said. The store owner and his wife attempted to calm down Leon until asking him to leave, police said.
A shirtless Leon returned about 20 minutes later with his finger on the trigger of what appeared to be a 9 mm handgun while yelling at the store owner and his wife, police said.
They told him to leave, police said. On his way out of the store, he told the owner the gun was fake and handed it to a juvenile who was just inside the door, police said.
Police were called and found the suspect across the street at Color Conspiracy Tattoo parlor at 27 Main St., police said. Leon told officers it was a misunderstanding, police said.
However, officers viewed the video surveillance footage from the store, which showed Leon waving a handgun and then giving it to a juvenile, police said.
Bond was set at $50,000 and he is scheduled to appear in state Superior Court in Stamford on Aug. 18.
