Dad Of Stamford Fire Victims Files Lawsuit

STAMFORD, Conn. — Matthew Badger, the father of the three girls who died in a Christmas Day inferno when their Stamford home caught fire, has filed a negligence and wrongful death lawsuit against contractor Michael Borcina and the city of Stamford.

Borcina is the boyfriend of Badger’s estranged wife, Madonna, and owner of Tiberias Construction, Inc., which had done extensive work on the home. The home was owned by Madonna Badger.

The fire killed the three girls and their grandparents, Lomer and Pauline Johnson, Madonna Badger's parents.

“The girls died before they could escape the home, which had become a firetrap as a result of months of substandard and dangerous construction leading up to the fire,” the suit said. The suit claims Borcina did not install fire and/or draft stops or working smoke detectors, and that the girls were allowed to live in the house with security and safety hazards, among many other complaints.

Badger’s suit says that the city negligently and recklessly demolished the house after the fire, although it was a piece of evidence, without the homeowner’s consent and without the state inspecting the damage.

Badger is filing the suit as the administrator of the estates of each of his daughters, according to court papers.

Other defendants in the suit include Michael Foley, Mike Foley’s Fine Carpentry, Inc., Robert Dean, New Canaan Design Partners LLC., Stephen Holt and Shoreline Electrical Contracting LLC.

Badger had filed intent to sue in early May. Madonna Badger’s brother, Wade Johnson, administrator of the Johnsons' estates, also has filed an intent to sue
